Thailand is NOT subject to Section 301 tariffs
The US Trade Representative imposed Section 301 tariffs on Chinese goods starting in 2018, ranging from 25% to 145% on top of base MFN rates. These tariffs apply specifically to goods manufactured in China. Thai-manufactured products are completely unaffected β they enter the US at standard WTO MFN rates.
The US and Thailand began Free Trade Agreement negotiations in 2004, but talks have stalled over agricultural market access and other issues. As of 2025, there is no US-Thailand FTA in force, meaning standard MFN tariff rates apply under WTO rules.
However, for most manufactured categories, MFN rates are modest (3β10%), and when compared to the additional 25β145% Section 301 burden on Chinese goods, Thai products are structurally more cost-competitive for US buyers β even without a preferential trade deal.

Every product imported to the US must be classified under the Harmonized Tariff Schedule (HTS). Correct classification is critical β misclassification can result in penalties.
Informal Entry: For shipments valued under $2,500 β simple process, no formal bond required. Formal Entry: For shipments over $2,500 β requires a customs bond, electronic entry via ACE (Automated Commercial Environment), and ISF filing. Work with a licensed US Customs Broker for formal entries.
Importer Security Filing (ISF) must be submitted to CBP at least 24 hours before cargo is loaded at the Thai port for ocean freight. The "10+2" refers to 10 data elements from the importer and 2 from the carrier. Failure to file ISF on time results in fines of $5,000+ per violation. Your customs broker handles this.
Food products require FDA Prior Notice before US arrival. Importers must register with FDA. Thai food manufacturers exporting to the US should hold HACCP certification and meet FSMA (Food Safety Modernization Act) supplier verification requirements. Cosmetics, dietary supplements, and medical devices also fall under FDA jurisdiction.
Consumer products must comply with Consumer Product Safety Commission (CPSC) standards β including children's products (lead limits, flammability), electrical products (UL or equivalent testing), and general use items. Electronics and radio frequency devices require FCC certification before import.

Country of origin is determined by where substantial transformation occurred. For Thai-manufactured goods, the manufacturer should provide a Certificate of Origin (CO) issued by the Thai Chamber of Commerce or the Department of Foreign Trade (DFT). Goods must be "made in Thailand" β goods merely assembled or minimally processed in Thailand from Chinese components may face scrutiny.
